INFORMATION TEXT FOR KARGOMSENDE CORPORATE PRICE OFFER APPLICATION

We, as Turkuvaz Dağıtım Pazarlama Anonim Şirketi (“Turkuvaz Dağıtım” or “KARGOMsende”), process a variety of your personal data under the Personal Data Protection Law No. 6698 (“PDPL”) and the applicable legislation, and we also expend every effort to protect the data we are processing by taking technical and administrative measures prescribed by law. We would like to inform you in detail about the processing processes of your personal data, with this Information Text for the KARGOMsende Corporate Price Offer Application of KARGOMsende (“Information Text”).

Within this context, Turkuvaz Dağıtım processes your personal data, by taking all required technical and administrative measures, within the limits prescribed by the personal data protection legislation, including particularly the Constitution of the Republic of Türkiye, international conventions to which our Country is a party, and the PDPL, in line with the following principles set forth under Article 4 of the PDPL:

  • Being in conformity with the law and good faith;
  • Being accurate, and where necessary, up to date;
  • Being processed for specified, explicit, and legitimate purposes;
  • Being relevant, limited, and proportionate to the purposes for which the personal data are processed;
  • Being stored for the period laid down by relevant legislation or the period required for the purpose for which the personal data are processed.

1- YOUR PROCESSED PERSONAL DATA AND PURPOSES OF PROCESSING

Name/surname, information about the shipment (daily average cargo quantity, approximate weight distribution of cargo packages, main cities to which shipments will be made), warehouse address where cargo will be received, general information about the products and e-mail address, telephone number and website address information

  • which are directly obtained from you for your applications that you will submit by filling in the Application Form in order to receive a price offer for corporate customers via the Applications page of KARGOMsende Website

are processed for the purposes of making of a price offer by KARGOMsende, carrying out corporate customer application processes, receiving your application, evaluating your application, carrying out communication activities, carrying out and auditing business activities, carrying out activities to ensure business continuity, receiving and evaluating suggestions for improving business processes, carrying out logistics activities, carrying out goods/service production and operation processes, carrying out strategic planning activities, carrying out supply chain management processes, following up on requests/complaints, providing information to authorized persons, institutions and organizations, and carrying out storage and archive activities.

2- METHODS OF AND LEGAL GROUNDS FOR THE COLLECTION OF YOUR PERSONAL DATA

Your personal data are collected by fully automatic means, through the filling in of the Application Form on the Kargomsende Website of Turkuvaz Dağıtım, by our prospective customers who apply for a corporate price offer, and are processed by fully automatic or non-automatic systems, provided that they are part of a data recording system.

Your personal data, whose processing purposes and methods of collection are presented to you, will be processed as per the following legal grounds set forth in Article 5 of the PDPL:

  • Where the processing of personal data belonging to the parties of a contract is necessary, provided that these are directly related to the conclusion or performance of the said contract,
  • Where personal data processing is necessary for the legitimate interests of Turkuvaz Dağıtım, provided that your fundamental rights and freedoms are not violated.

3- TRANSFER OF YOUR PERSONAL DATA

Your personal data may be transferred to:

  • Business partners, performance assistants and suppliers of Turkuvaz Dağıtım for the achievement of the above purposes of processing, receiving support for business processes and during provision/development of services, execution of storage and archiving operations, and ensuring infrastructure and technical security
  • lawyers, auditors and tax advisors of Turkuvaz Dağıtım and other third parties from whom Turkuvaz Dağıtım receive service, in order that Turkuvaz Dağıtım can carry out our business processes lawfully and in accordance with its legitimate interests and exercise its right of defense in a possible judicial process;
  • Agents and representatives authorized by you, in order that Turkuvaz Dağıtım can fulfill its legal obligations;
  • regulatory and supervisory authorities and other public authorities, such as courts and execution offices, and other public institutions or organizations authorized to request personal data, in order that Turkuvaz Dağıtım can fulfill its legal obligations;

pursuant to Article 8 of the PDPL.

4- YOUR RIGHTS REGARDING THE PROTECTION OF YOUR PERSONAL DATA

Regarding your personal data, you have the rights to:

  • (a) learn whether or not your personal data are processed;
  • (b) request for relevant information, if the personal data have been processed;
  • (c) learn the purposes of processing the personal data and whether or not those data are used in compliance with the purposes;
  • (d) know the third parties in the country or abroad, to whom your personal data are transferred;
  • (e) request for rectification in case your personal data have been processed incompletely or inaccurately;
  • (f) request for erasure or destruction of your personal data within the framework of the conditions stipulated by Article 7 of the PDPL;
  • (g) request that the operations carried out under paragraphs (d) and (e) of the same be notified to the third parties to whom your personal data are transferred;
  • (h) object to occurrence of any results that are to your detriment through analysis of your processed data exclusively by automated systems;
  • (i) request for compensation of the damages in case you incur damages due to the unlawfully processing of your personal data.

You may submit your requests within the scope of the aforementioned rights to us in writing, via registered letter with return receipt, by visiting us personally, or via notary public, or by using registered electronic mail (REM), secure e-signature, mobile signature, or via your electronic mail address that you had informed us of previously and that is recorded in our systems, if any.
